(2)Confiscation of the applicants permit by a police officer or authorized representative of the Department. The term includes existing or proposed streets, lanes, alleys, courts, and ways. (2)Where property abutting the right-of-way line could be used as parking area, the permit may require curbing, permanent guardrail, or fencing to be constructed along the right-of-way line in order to prohibit vehicle encroachment upon the sidewalk or shoulder area.
